PRIVACY NOTICE FOR CANDIDATES

1. INTRODUCTION
NetEase Games is committed to respecting people’s privacy. This Privacy Notice (“Notice”) explains how we collect, use, and disclose your personal information when you apply for a position with us as a candidate. It also describes how to exercise your rights under applicable laws.
NetEase Games and its affiliated companies operate in different locations around the world. In this Notice, when we say “NetEase Games,” “we,” or “us”, we are referring to the hiring entity that you are engaging with for the job application. Where applicable, such a hiring entity is the data controller.
2. THE TYPES OF PERSONAL INFORMATION WE COLLECT
We collect the following information about you in connection with your job application, directly from you or indirectly from third parties (such as referees):

Basic information: including your name, date of birth, headshot (if you have included it in your resume), home address, email address, and phone number.

Employment information: including employment history, education, language abilities, qualifications, references, and other information in a resume or cover letter or as part of the application process.

Recruitment information: including proof of eligibility to work, details of any work permit application, and background screening information.

Any other information you provide during your application and interview process, including the results of any job skills tests undertaken, any non-compete clauses you might have with your previous employers, and whether you have any relatives working with us.

Videos captured by security cameras or other information collected about you if you come for your onsite interviews.
We may also collect the following categories of sensitive personal information about you:

CCTV footage data and other information related to your use of our premises if you come for an onsite interview; and

Demographic information, including protected classifications, such as gender.
3. CALIFORNIA NOTICE
If you are a California resident, we may collect the following categories of information about you as defined in the California Consumer Privacy Act of 2018 (“CCPA”):

Identifiers (such as your name and email address).

Demographic information (like age and gender).

Audio, electronic, visual, or similar information (like headshots or CCTV footage).

Employment-related information (such as job history and performance evaluations).

Education information (such as information within your resume or background search).

Other “personal information” such as any non-compete clauses you might have with your previous employers, and whether you have any relatives or friends working with us.

Inferences drawn from any of these categories.
We do not “share” or “sell” your personal information, as defined in the CCPA.
4. HOW WE USE YOUR PERSONAL INFORMATION
We use your information for the following purposes and, where applicable, based on the following legal basis.

managing recruitment related activities, which include conducting interviews and job skills tests for applicants, evaluating the results, and conducting background checks to the extent permitted under applicable law. Where applicable, such processing is contractually necessary for the hiring process.

ensuring compliance with applicable laws such as immigration and employment laws. Where applicable, such processing is necessary for a legal obligation.

ensuring compliance with our internal policies. Where applicable, such processing is necessary to fulfill our legitimate interests in security and safety, internal audits, and others.
To the extent that consent is required as the legal basis for processing your personal information, you consent to our collections, uses, and disclosures of your personal information pursuant to this Notice by your application for a position with us.
5. HOW WE SHARE YOUR PERSONAL INFORMATION
In order to fulfill our legitimate interests of carrying out recruitment activities, your information may be transferred to and processed in countries outside the country where you live. Where applicable, we use European Commission approved Standard Contractual Clauses to protect your information during the transfer. If you apply for a position from outside the United States, you consent to the processing of your information in the United States.
We may share your personal information with selected third parties in and outside your country, including:

Affiliated NetEase group companies where your information is shared on a need-to-know basis to selected team members such as HR to manage our recruitment activities.

Law enforcement agencies, public authorities or other judicial bodies and organizations when we are legally required to do so, or if we have a good faith belief that such use is reasonably necessary to: (i) comply with a legal obligation, process or request; or (ii) resolve disputes, conduct audits, or establish legal defenses.

third party service providers for the purposes of processing your application, such as in connection with a relocation, to coordinate travel, or to conduct background checks. Specifically, your personal information will be shared with Greenhouse Software, Inc., a cloud services provider located in the United States who manages the recruiting process on our behalf.

Professional contacts, including referees and your prior employers that you have provided to us.
6. THE SECURITY OF YOUR PERSONAL INFORMATION
We are committed to ensuring the security and integrity of your personal information. We employ technical and organizational measures to safeguard your information during transit and at rest including access controls and encryption.
7. DATA RETENTION
Your information will be retained for as long as necessary for the recruiting process. Your information may be retained for longer if required by law or a court order, or as needed to defend or pursue legal claims.
8. YOUR RIGHTS
Depending on where you live and subject to certain exceptions, you may have some or all of the following rights:
- Right to Know: The right to request that we disclose to you the personal information we collect, use, or disclose, and information about our data practices.
- Right to Request Correction: The right to request that we correct inaccurate personal information that we maintain about you.
- Right to Request Deletion: The right to request that we delete your personal information that we have collected from or about you.
- Right to Request Restricted Processing: The right to request that we restrict processing of your personal information
- Right to Non-Discrimination: The right not to receive discriminatory treatment for exercising your privacy rights.
- Where applicable, you may also have the right to designate an agent to exercise these rights on your behalf. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us by providing additional information, such as a government issued ID.
